Controlling Internal Access To Local Government Records
Common Law Right to Access
Local government elected officials and employees have the right of access
to local government records, in common with other members of the public
under the Freedom of Information and Protection of Privacy Act (FOIPPA).
However, it is not that type of access that is at issue here: it is
the access to and, in some cases, the possession of municipal records
that flows from the fact of being elected to or employed by the local
government. That is not a right of access held in common with members
of the public generally.
