The Other Side of Business Licensing: Professions, Trades and Businesses Licensed, Certified or Registered under B.C. Statutes

In relation to the authority for a municipality to licence businesses and to impose requirements for the licences, the Community Charter states as follows:

61 A provision in a bylaw under section 8 (6) [spheres of authority – business] that requires an examination or certification osf a person engaged in a trade or occupation does not apply to a person who has been granted a certificate or other evidence of competence for that trade or occupation under a Provincial or federal Act.

Our legal researcher, Lyle Rumpel, compiled a list of Provincial requirements for licences, certification and registration to enable local governments to check business licence applications for the required provincial credentials.

Please note the following:

  • This list includes operators of specified businesses (e.g. fish processing) but does not include licensing rights to use land (e.g. under the Forest Act; approval of the source of mineral water for trading purposes under the Health Act; under the Range Act) or its resources (e.g. hunters under the Wildlife Act)
  • Provincial statutes not only licence for the purpose of regulating professions, trades, and businesses but also certify or register for that purpose - therefore this list includes those types of statutory provisions as well
  • The list does not include statutes if they regulate without also licensing, certifying, or registering
